Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Condo Inspect Pro ("the Service"), operated by Condo Inspect Pro ("we", "our", or "us").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the Terms, you may not access the Service. You must be at least 18 years old to use this Service.

Description of Service

Condo Inspect Pro is a web-based property inspection management platform designed for condominium property managers, superintendents, and board directors in Ontario, Canada. The Service provides:

  • Building profile management and portfolio organization
  • Inspection template creation with Fire Code compliance items
  • Mobile-optimized inspection capabilities with photo documentation
  • Deficiency tracking and resolution management
  • Incident reporting and documentation
  • AI-powered document scanning and data extraction
  • Board-ready PDF report generation
  • Analytics dashboards and compliance trend tracking
  • Team management with role-based access controls

User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring that your use complies with these Terms

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.

Subscription Plans and Billing

Condo Inspect Pro offers subscription-based access to the Service. By subscribing, you agree to the following:

Subscription Tiers

We offer multiple subscription tiers (Individual, Team, Growth, Portfolio, and Enterprise) with varying features and building limits. Current pricing and plan details are available on our website at condoinspectpro.com.

Free Trial

New accounts may be eligible for a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. Trial access is limited to one trial per organization.

Recurring Billing and Auto-Renewal

Subscriptions are billed on a recurring monthly or annual basis. Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You authorize us to charge your payment method on file for recurring subscription fees.

Payment Processing

Payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method. All fees are quoted in Canadian dollars (CAD) unless otherwise specified.

Cancellation

You may cancel your subscription at any time through the Settings page in the application or by contacting us. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period
  • You will not be charged for subsequent billing periods
  • You will retain access to the Service until the end of your paid period
  • No partial refunds are provided for unused portions of the current billing period

Refund Policy

Subscription fees are generally non-refundable. However, we may issue refunds at our discretion in the following cases:

  • Service outages lasting more than 48 consecutive hours
  • Billing errors or duplicate charges
  • Within 48 hours of an initial subscription if the Service does not meet the described functionality

To request a refund, contact us at support@condoinspectpro.com with your account details and the reason for the request.

Price Changes

We reserve the right to modify subscription pricing. We will provide at least 30 days' notice before any price increase takes effect. Price changes will apply at the start of your next billing cycle after the notice period.

Acceptable Use

You agree to use the Service only for lawful purposes related to property inspection management. You shall not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Upload malicious code, viruses, or harmful content
  • Interfere with or disrupt the Service, servers, or networks
  • Impersonate another person or entity
  • Share your account credentials with unauthorized parties
  • Use the Service to store or transmit infringing, defamatory, or unlawful content
  • Use automated means to scrape, crawl, or extract data from the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

Data and Content

Your Data

  • You retain ownership of all data and content you upload to the Service
  • You grant us a limited, non-exclusive license to host, store, process, and display your data solely to provide the Service
  • You are responsible for the accuracy, legality, and appropriateness of your data
  • You must have all necessary rights and consents to upload and share any content, including photos of building areas

Data Protection

We handle your data in accordance with our Privacy Policy. By using the Service, you consent to our data practices as described therein.

Data Export

You may export your data at any time through the reporting features in the Service. Upon request, we can provide a complete export of your data in a standard format.

AI Features

The Service includes optional AI-powered features, including document scanning and data extraction. By using these features:

  • You acknowledge that AI-generated results may not be 100% accurate and should be reviewed
  • You consent to uploaded images being processed by our AI service provider (OpenAI) for data extraction
  • You remain responsible for reviewing and verifying all AI-extracted data before use
  • AI features are provided as-is and we make no guarantees about accuracy or completeness

Professional Responsibility

Condo Inspect Pro is a tool to assist with property inspections and compliance documentation. You acknowledge that:

  • The Service does not replace professional judgment, expertise, or licensed inspections
  • You remain solely responsible for the accuracy of inspections and reports
  • Compliance with applicable laws, regulations, and building codes is your responsibility
  • The Service may not cover all inspection requirements for your specific jurisdiction or building type
  • You should consult qualified professionals for specialized assessments (fire safety, structural, etc.)
  • Inspection templates are provided as guidance and may need customization for your specific requirements

Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by Condo Inspect Pro and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the Service without our express written permission.

Service Availability and Modifications

  • We strive to maintain high availability but do not guarantee uninterrupted or error-free operation
  • We may modify, suspend, or discontinue any feature of the Service with reasonable notice
  • Scheduled maintenance windows will be communicated in advance where possible
  • We are not liable for any loss resulting from temporary unavailability of the Service

Disclaimers and Limitation of Liability

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONDO INSPECT PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Condo Inspect Pro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content or data you upload to the Service
  • Your violation of any applicable laws or regulations

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for material breach of these Terms, fraudulent activity, or illegal use.

Upon termination:

  • Your right to use the Service will cease immediately
  • You may request export of your data within 30 days of termination
  • Provisions that by their nature should survive termination will survive (including disclaimers, limitations of liability, and indemnification)

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the courts of Ontario, Canada.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page, updating the "Last Updated" date, and where appropriate, notifying you by email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
